For an industry desperate for new sources of cobalt, nickel, copper, and manganese, this is potentially a game-changer. For marine scientists and environmental advocates, it’s a regulatory green light into largely uncharted ecological territory.
The Mechanics of the New Framework
Under the Deep Seabed Hard Mineral Resources Act (DSHMRA): legislation that has sat relatively dormant since its passage in 1980: NOAA holds the authority to issue licenses and permits for U.S. companies seeking to extract hard mineral resources from the international seabed beyond any nation’s exclusive economic zone.

The finalized rule introduces three critical procedural changes that significantly accelerate the path to commercial production:
Combined Applications: Companies can now submit exploration and commercial recovery applications together rather than completing exploration first and then applying separately for recovery rights. This alone eliminates what could have been a multi-year gap between phases.
Merged Environmental Review: The National Environmental Policy Act (NEPA) review process has been consolidated, meaning a single comprehensive environmental assessment covers both exploration and extraction activities rather than requiring sequential reviews.

This regulatory modernization didn’t emerge from a vacuum. The finalized framework follows Executive Order 14285, signed by President Trump in April 2025, which directed federal agencies to advance U.S. leadership in seabed mineral exploration as a matter of national economic and defense priority.
The administration’s argument centers on supply chain vulnerability. The polymetallic nodules resting on the ocean floor contain precisely the metals that underpin the clean energy transition and modern defense systems: manganese for steel production, nickel and cobalt for lithium-ion batteries, and copper for everything from electric vehicle wiring to grid infrastructure.

Currently, global supply chains for these minerals remain heavily concentrated in a handful of nations: the Democratic Republic of Congo dominates cobalt production, Indonesia leads in nickel, and China controls critical refining capacity across multiple metal categories. Deep-sea mining, proponents argue, offers the United States an opportunity to diversify supply and reduce strategic dependence on geopolitically sensitive sources.
The seabed resources in question are substantial. The Clarion-Clipperton Zone in the Pacific Ocean alone: an area roughly the size of the continental United States: contains an estimated 21 billion metric tons of polymetallic nodules. These potato-sized formations took millions of years to form, accumulating metals layer by microscopic layer on the ocean floor.
First Movers and the Permitting Pipeline
The regulatory framework arrives with applicants already queuing at the door. On December 23, 2025, NOAA announced it had received exploration license applications from The Metals Company (TMC USA), a subsidiary of the Canadian-listed firm that has positioned itself as the most aggressive corporate advocate for commercial deep-sea mining.
TMC has spent years securing exploration contracts through the International Seabed Authority (ISA) and conducting pilot collection tests in the Clarion-Clipperton Zone. The company argues that harvesting nodules from the seafloor represents a lower-impact alternative to terrestrial mining, pointing to the absence of deforestation, the minimal freshwater requirements, and the lack of child labor concerns that plague certain land-based mineral supply chains.
Public hearings on TMC’s applications are scheduled for January 27–28, 2026: just days away: setting the stage for what promises to be a contentious public comment period.
Environmental Concerns: The Unknowns Run Deep
Critics of the NOAA framework argue that regulatory streamlining has outpaced scientific understanding of deep-sea ecosystems. The abyssal plains where polymetallic nodules rest are not lifeless deserts; they host unique communities of organisms adapted to extreme pressure, near-freezing temperatures, and perpetual darkness.

The ISA itself has been debating: and repeatedly delaying: finalization of its own mining code, a comprehensive regulatory framework that would govern commercial extraction in the Area. Some nations, including several Pacific Island states with strong cultural and economic ties to the ocean, have called for outright moratoriums on deep-sea mining until more research is conducted.
What Comes Next
The NOAA framework is now in effect, but commercial deep-sea mining in international waters remains years away from actual production. Even under the accelerated permitting timeline, companies must complete environmental assessments, secure financing, and develop extraction technologies capable of operating reliably at depths of 4,000 meters or more.
